Ending Tenancy, Being asked for an additional 'final rent payment'

My tenancy started on the 2/7/06. I have handed in my notice to leave on the 1/8/09.

I have recieved a letter from my agency stating:

"You will need to make a final rent payment before 1st of August of £18.90 (£ 18.90 per day) for the period 1st of August inclusive. You can either amend your final standing order payment... blah blah"

Now surely 1st of August is part of my normal rental payment as it runs from the 2nd of the month to the 1st inclusive..?

I have already queried this with them, but getting me worried if they are already trying to scam money off me! They already want £25 + vat for references cheeky sods. :mad:

    Expiry date to and including 1st January 2008
    Rent is payable in advance and is due upon the 1ST day of each rental period

    Annoying though it is to have to cough up for a "reference" ( which essentially consists of answering "does he pay on time, has he ever trashed the property") you have to remember that the LA is contracted by the LL, not by you. The reference does not help the current LL, it helps you, therefore you have to pay for the LA's time. However, it's always worth doing what a T in another thread is looking at - an "I want reference, you want to conduct viewings"exchange.

    Your fixed term contract began on the 2nd of the month, running through the 1st of the following one so, if your rent is normally paid on the 2nd then, as you say, there will be no rent adjustment necessary as you have given (more than ) the required notice to tie in with the rental periods.

    I think that what may have happened is that because you've actually given notice a day or so earlier than you needed to, the usual less than bright spark at the LA's office has misinterpreted the phrase "Rent is payable in advance and is due upon the 1ST day of each rental period" as meaning "the 1st of day of each month" , failing to grasp that your tenancy in fact runs from the 2nd of the month.

    The poor dears need your help: Send them a letter which says simply:
    "Thank you for your letter. My tenancy runs from 2nd of the month to the 1st of the following month inclusive and therefore my rent payment on 2nd July will fully cover the period of my notice. You may have become confused because I gave my notice slightly earlier than required to."
    Maybe you could charge them £25+vat for *your* letter ;)

    Check all your ASTs. 2008 had 366 days and I've "lost" one day as for my Agency Year = 365 days.

    According to the LA I paid an apportioned rent of £567.12 when I started the rental for the period of the 2nd to the 31st (inclusive) of July.

    a) £575 (my rent) minus £18.90 (a days rent - 575*12/365) does not equal 567.12...

    b) Why would you apportion rent to be out of sync with the rental periods?

    Are they trying to say my rental period is the 1st-31st inclusive, in which case I've said I'll move out a day earlier.
