Jsa/Is overpayment help

Can anyone help me please with an overpayment issue.

I do not work and am not currently actively seeking work, do not receive JSA. My boyfriend, however, is does receive JSA.

I put in a claim for Income Support in February and my claim was awarded.

I received a letter last week and have been told that I was never entitled to IS due to my boyfriend receiving JSA and I now have to pay back the IS that I have received.

This doesn't seem very fair to me. Its not my fault I was falsely awarded - Will I be expected to pay the whole amount back ?

    When you applied for Income Support did you state that your partner, who I assume you have been living with, was on JSA?

    I did yes, it is a joint claim.

    It think it was because I am sick/disabled , I dont have the award letter handy sorry

    If you gave them all the correct details then it's possible it is an official error and therefore not recoverable. Appeal the decision within one month.

    I've just had a thought - if you claim was in February why was it IS you claimed? If you were incapable of work it should have been ESA (if my memory regarding the dates serves me correctly). IS for new claimants is only for certain lone parents or carers

  • all im gonna say is read the over payment letter very carefully, AND dont say you will pay it all back offer a small sum ;);)
