Two Estate Agents One Property Saga

Hi all

I have been a long time reader (great advice thank you) but haven't found the need to post till now!

We are first time buyers and have just brought (so we thought) a property, offer agreed, solicitor appointed, mortgage signed off, passed the underwriters and just awaiting the survey now, However the other estate agent that we have not dealt has refused to take the property off the market and phoned the vender with an offer of £3k above our agreed amount and said that we were not that bothered about the property due to us not having a survey completed yet which is completey untrue. Is this right to do? (sorry for the rant)

    the estate agents can only take the property off the market with the vendors instruction. You need to speak to the vendors, the other estate agent is well within their rights to show potential buyers the property unless instructed otherwise.

    hmmm... when we went for a house that was through 2 agents i made the vendor take it off the market on both of them..

    Let me see if I've got this - one agent accepted an offer, the vendor instructed the other agent to take it off the market (as well as the first agent doing so), and the other agent REFUSED TO TAKE/OBEY HIS CLIENT'S INSTRUCTIONS and kept marketing it?

    walk away, lots of property about - if they're being a pain now things might get even worse

    they should be lucky to have a buyer

    The thing is within the area we are buying houses are in short supply and going for asking price or above I was out bid on another property because a cash buyer came along with £10k over the asking price! I have looked around and nothing fits the bill for us shame though we get on well with the vendors, plus i'm down £600 already feel like giving up and renting for the rest of my life!

    yep thats what we have been told because they haven't sold it and therefore won't do it, they are the same estate agent that let us down for 4 viewings (no show) and hung up on my wife when she asked about a property details saying we are to busy!

    As a buyer when I make an offer I make it subject to the property coming off the market.

    As a seller I would always refuse this condition unless you paid the asking price

    thanks for that I have lots to learn! I got accepted £2.5k below the asking price

    I would imagine the vendors were holding out for a larger offer and now they have it.
