A complete mess.

Hello all,

I am not sure if I should be posting for help here but here goes anyway!

I have been a life long account holder with Abbey National or Abbey as it is now called. About 5 years ago I took on a student account with them and an overdraft that soon was maxed out at 1600.00. I did have a monthly wage going into the account up until about 6 months ago and this is the reason why.

3 days after I got paid I went to the local shop to buy a few things and my card was rejected. I went to a cash point and noticed my overdraft limit with no warning letter phone call or anything had gone from 1600.00 to 500.00. This was on the last day of the month. As there was no money to take on the first of the month I then had 10 standing orders and direct debits rejected, Abbey then charged about 350.00 for this. After phone calls and eventually a trip to my local branch the charges where refunded and the overdraft tempererally reinstated. So what I did took the money out, set up an account with Barclays and now my wages and bills go in and out of here. I was put onto a minimum payment plan of 70.00 per month for the overdraft which I told them I could not afford (no letter or any confirmation of this so called plan was ever sent to me).

The worst thing is I no doubt got a load of marks on my credit reference file for missing a payment.

The reason I am calling out for help now is I have got a letter today saying pay the full balance or a default will be registered on your credit file.

I ask everyone, how would I go about making a complaint about this and stop this mess?

    In writing and include an income and expenditure form and an offer that you can afford to pay the overdraft back.

    As an aside a Subject Access Request might be in order to reclaim any outstanding charges NOT refunded already.

  • Is the subject access request the one where I have to pay 10.00.

    I haven't done this previously because I thought with all the court thing I wouldn't be able to claim anyway.

    I think you need to know whether what you owe them and what they owe you is as much as you think it is. £10.00 is the statutory amount.
