Bank charges. Replay letter from lloyds tsb.

Hi, just received a replay letter from Lloyds TSB regarding my claim and I am not quite sure on where to go next. Should I make a claim through the courts or wait for final decision of OFT.
The letter goes like this:

... For the time being, during the determination of the legal issues in the test case, the FSA has agreed we can suspend the normal timetable for dealing with complaints about unplanned overdraft charges.

The FOS has also generally decided to put all investigations concerning the fairness and legality of unplanned overdraft charges on hold, until the conclusion of the test case.

If you're thinking of making a claim through the courts, please note that we will be asking the courts to postpone proceedings about bank charges until the conclusion of the banks' proceedings with the OFT.

We appreciate that you may have wanted to have your complaint dealt with more quickly, but we can assure you we are taking steps to ensure that your complaint will not be disadvantaged whilst the test case continues....

    Standard reply letter from Lloyds, I'm afraid.

    Take it to court, your case will be stayed due to the test case. Only a handful of people have been successful insofar as having a stay lifted, at the county courts.

    Have you thought about applying under the FSA hardship waiver: introduced July 2007 ( when county court cases, were stayed? ).

    You'll have to complete an income and expenditure form, and apply under the hardship waiver, promoting your priority debts ( note: when the dear old FSA launched the hardship waiver, it covered debts. such as credit cards and loans: this is now being overlooked by most banks, inc. Lloyds ). Lloyds may ask you to visit Moneyadvicetrust.com website, to complete an I & E form.

    Y'know Baroness Hale, last week in the House of Lords, had a go at the QC representing the banks; because she could not believe one bank in particular, didn't know the gen. public were up in arms re: bank charges.

    I bet it was Lloyds/TSB or Abbey.

    Lloyds are being extremely difficult re: refund of bank charges, under the FSA hardship waiver.

    There is no reason to take the case to court as your claim is logged by the Bank. If you are financial hardship then you can ask them to look at your case as fanancial hardship.
