Buying house with leased garden

hello
I'm currently in the final stages of buying a house and at the final hurdle the vendors solicitors have finally get round to sending the terms of the leased garden only to find it's on 3 months notice; so at any point the council can take the land back with 12 weeks notice. This is after finding out that it has 35years left instead of 42 - which doens't really matter with the notice anyway.........
Has anyone any experience of leasing a garden or finding out something like this at the final stage of a purchase.

If you were assuming the property came with a garden, and now find the garden is not part of the freehold and/or comes with conditions, I would think hard about whther to buy and/or re-negotiate the price.0

Knew it was leased, but was told it was on a 42 year lease that turned out to be 35 years with this 3 months notice period. So really it's on a 3month rolling contract.
It's a big change from the initial 50 years lease to the 42 years the vendor told us to the now 35 years on a rolling 3 month.
Spent alot already on specialists looking at the property as well as it's old.......0 -
My in laws bought their house with about half of the garden leased from the council.
The council were very open to them purchasing it - it was no real use to anyone but the in laws, likewise the patch that their neighbours had also.
We helped them buy it for £1000.Everything that is supposed to be in heaven is already here on earth.

I would think hard about whther to buy and/or re-negotiate the price.0

Yeah - It needs alot of work which we'll be doing some reneg on, also with the developments about the misrepresentation of lease I think we'll be taking that into account as now I'm in the process of get my solicitor involved in looking into buying the land - which again is costing money......

Well - the council have offered a 125 year for £12500 :shocked: PLUS ALL fees.....
Seems pretty steep to me! Have asked if the vendor can go back to the council and see if they can go for less or a payment scheme.....
otherwise the job is b*ggered I reckon. Not good :-(0 -
3 months notice= buying with no guarantee of a garden
125 year lease= getting a garden.
Bit of a no brainer really. at that price £1k is getting you 10 years. The vendors originally said 50 years so I'd expect £5k off the price.0

Well finally progress is afoot. Secured the garden for 100years and addressed the price of the house with a small reduction (not as much as the garden will cost).
Pleased to say thay all parties have been really helpful and all seems to be heading to exchange.
Goes to show that if you take your time and are reasonable it can do the trick !!0 -

I agree with that entirely. Most 'problems' can be worked through with patience and good advice.
