Are Dell acting legally?

distance selling regs might be your best option if you are a personal buyer....but I dont think you have the same rights if you went through the business site.I'm now a retired teacher... hooray ...:j

2 weeks doesn't seem a long time, really, but I think you need to note that "time is of the essence" in your communications.
I ordered a Dell laptop (an XPS with a very hi-res screen) a while back and they quoted me a longish delivery but then it arrived earlier anyway.0 -
I dont think that DSR applies to personalised products, as dell can claim that each laptop is built specifily for each person as you can to tick various options and choose what you want.:beer:In My 'Permanant' Pre-Masters Gap Year

thanks again for the replies.
The DSR does extend to personalised products, if the products are built with off the shelf components. PC configurations are specifically stated as falling within the act.
So unless I paid Dell to design a new model for me, that is, something not based on their "standard" design, then you are right - the DSR wouldnt apply.
But options and upgrades are definitely covered0 -
prowla, I honestly did make it painfully clear to dell each time I spoke to them, that the order was super urgent. I told them it was to replace a broken one, and ive got 3 months to finish my thesis, hopefully you can see why I cant wait 1/3 of that time for Dell to come up with a machine, or a refund. if this was for surfing or gaming, I would wait0

Hope you get sorted, the only problem I'd see is when you placed the order and it said delievery on 10th July, and they then said no not due to 11th Aug, then theres a breach of contract, thats the only way out I can think of, sorry, hope u get sorted one way or another xxx rip dad... we had our ups and downs but we’re always be family xx0

thanks mum2one

I just had a look at online banking, and the money is available, which is weird - I thought authorisations reserved the amount against your account balance. or rather the amount left to spend
Ive emailed Dell my request to cancel, and stated they cannot refuse under UK consumer law. If I go into town and buy one (which I pretty much have to do, despite the risks), what happens if Dell then take the money in a few weeks? I will speak to someone in my branch tomorrow, maybe if I pre warn them of the possibility (of going WAY over my authorised overdraft), but also that I intend to immediately dispute the transaction, maybe they wont apply the usual penalties
Hoping it wont come to that. But I just transferred the money out of that account, incase the computer changes its mind

I always buy Dell computers and my last two I have brought via Dell. My last Dell though I brought via their Ebay shop. They sell the slightly damaged Dell computers. Anyway I got a top of the range business computer with all the bells and whistles PLUS 3 years next day repairs warranty all for £300 inculding postage. OF course your limited to what they have to what you buy but bargain!
Can't you just take delivery and then return it to them as you don't want it. Distance Selling Regulations and all that. I know its a lot of hassle but its probably easier than trying to fight through a system heading just one way.0
