i have had a claim for bank charges on hold since july 2007, (i must of been one of the very last ones to miss out) i can claim back to 2001,can i claim charges from 2007 to 2009 so instead of claiming back to 2001 i claim back to 2003, and leave out 2001 and 2002

    Is the case on hold with the bank or the county court?

    The FSA waiver says:
    (14)
    the firm must not take into account the period between 27 July 2007 and the date of termination of this direction (the “stay period”) for the purposes of relying on any limitation period (or periods) or time limits within which complainants must:
    (a)
    make relevant charges complaints;
    (b)
    refer relevant charges complaints to the Ombudsman; or
    (c)
    bring claims before the court;

    and the firm must not otherwise limit any redress that may be due to the customer, when complying with DISP or otherwise, because of the stay period;
    In other words you can claim from now back to July 2001. You can add 2008 & 2009 charges, but do not have to forgo 2001 & 2002 charges
