Financial Hardship Refused Halifax

hi all
Wondering if anyone can offer any tips / advice?
I have applied for bank charges with Halifax worth approx £6k. They have put it on hold due to the test case however I was advised by a friend that they recieved their charges back after declaring they were in financial hardship.
Between my partner and I we have approx £40k of debt and over Xmas just gone had to do a Voluntary Repossession with our house to which the Mortgage company have just sold it £40k less than our mortgage so we are in approx £80k of debt however the mortgage company have not chased us for the £40 yet but were expecting a letter any day now!
We have payment plans in place at the moment for most of our debt...a couple have started threatening us with Court and sending the good old trusty bailiffs round so I re-contacted the bank to explain we were in financial hardship to which they have sent yet another letter declining any refund and advising us to fill in a financial statement?
Is this worth doing or is it worth going direct to the FOS...we are considering bankruptcy once the mortgage catches up with us but having the bank charges could help right now.
Any Ideas what the best route to do is and what the chances are of ever getting bank charges back???

Well that wouldnt be sensible would it? At the end of the day our debt is not iresponsible debt like credit cards and loans etc...there is genuine reasons we are in £40k worth of debt...and the only reason we had to give up the house was because the mort company wanted £1200 a month mortgage payment for a £100k mortgage and we couldnt sell it due to the house prices falling at the same time so had no choice.0

I think you should start the process off but I think the problem is with regards to priority debt arrears(mortgage/rent, council tax, utilities). I think you said that you do not have arrears but have repayment plans in place...the bank may reject the case but you can always ask the questionCliffandSarah wrote: »Well that wouldnt be sensible would it?
