Argos reclaiming charges repsonse letter

Hi

i just have a quick question, I'm trying to reclaim charges from Argos most of which are before April 2007.

Their first offer was just the difference between each charge and £12 which I didn't accept, sent the letter threatening court action and they have responded saying that they are not changing their original offer and have also included this sentence:

"The only default charges that the financial Ombudsman Service would review are any that are charged after April 2007"

Are they trying to pull a fast one?

    Yep. They're trying to dissuade you from filing at court

    Thanks for replying :) I'm going to respond with a letter to the address they gave saying that I still don't accept their offer and take it to the FOS...time will tell I suppose!

    However, I think one further letter is required to Argos pointing out that OFT 842 specifically stated only a court can decide a fair charge and that to save legal costs to them you will settle for(full amount of claim plus interest) or you will sue them in the County Court.

    I hate doing this to you (since when? :D)but isn't April 2007 when the FOS had control of complaints over catalogues companies due to changes within the CCA 2006? Before then there were other organisations that dealt with catalogue complaints.
    That's why suggested filing at court, rather than the FOS

    i am wondering if you can help as i can see you already have a claim going with ARGOS

    i dont understand the statement that they have sent me, what can i claim back?
