First of all John can I say how grateful I am to you and that there are people like yourself in the world that are willing to give their time to help others
We are to be tenants in common so that it is distributed according to our wills rather than going all to one of us if the other dies. I have already received back the title with our names on it , Very fast work by the land registry I think
It is a letting agent whom I am inquiring about, the selling agent was a different company and has been dropped after 8 months of no luck trying to sell it.
I am talking about the letting agent who has found us a tenant (who has now moved in) but they are not collecting rent or managing it for us as we are doing that ourselves.
The flat is sheltered accommodation with a 55 or over age restriction (the tenant is 56 and has confirmed this with a copy of their driving licence to the freeholders).
The reason why I ask is that now we are both the owners the current contract with the LA that was signed by just me as I was the only executor of the will so is valid at the moment but when/if the tenant wants to stay after this 12 months is up then surely me and my brother would have to sign a new contract with the LA for the contract with them to be valid.
I am thinking about the 8% renewal fee the LA will charge us for every year the tenant stays on and was wondering if we could negotiate a lesser fee if the contract with the LA would no longer be valid?
Although this is an after thought now that they have found us a tenant and may seem a little callous it also seems a bit excessive to charge nearly months rent plus VAT for doing nothing other than witness the signing of the new 12 month tenancy agreement as the Tenancy agreement is drawn up and sent to us by the freeholder?
I should have brought it up at the time but being a little nieve to all this I didn't read the agreement with the LA properly until I got home.
The Tenancy agreement was signed by just me also and I presume also that if/when a new one is to be signed that we will both have to sign that also?0 -

I have a little experience of landlord tenant relationships, but fortunately for me I never needed to use an agent. I do know it is a murky world when you do.
Mind you if you do it yourself you can find yourself serving your own eviction notice in person and dreading Christmas Eve - because if the heating system breaks down or the roof starts leaking, or the key snaps off in the lock - it will do it on Xmas Eve.
These days the only rental contract I have is Grandma's field and that really is a can of worms (no pun intended)
Make sure the tenant's deposit is properly protected, the energy performance certificate has been issued and there is a gas safety certificate in place.
There are some helpful Landlords on here, if you check their postings and do searches for the topic that is bothering you, like renewal fees, you might find a practical explanation of the topic.
The poster named "clutton" comes to mind - go to search and then advanced search and enter the name clutton and you will see what I mean.

All the above things have been taken care of and the deposit has been put into a government protected scheme and certificate has been given to the tenant
