Default on a Vodafone contract i was disputing

I hope I am not posting on the wrong board. I tried posting on the Debt free wanabee, but wasn't getting the right type of advice I was after so am trying on here.

This is with regards to an 18 month Vodafone contract that I entered into with a cash back company. As you probably guessed, I did not receive the cash back despite following all the terms and conditions and actually the company went bust even before the contract was supposed to have come to an end so I never really had a chance!

After being in dispute with Vodafone over the contract for nearly a year - I was arguing that the terms of my contract had been breached, they argued that I was still liable for the contract I had with them - I settled the account with them but the default is still recorded against me.

It’s not actually about the contract that I need help about - I came to the realisation that I was not going to get anywhere with Vodafone about what I believed was a breached contract and so settled the account back in February. What I would like to change if it is possible, is getting this default removed from my account, because I was basically in dispute with them which is why I did not settle with them earlier. It seems unfair that this default should affect my credit file for the next 6 years for such a small amount (£149) and when I was questioning whether I was actually liable for the contract. If anyone has any advice on what I should write to Vodafone in terms of the law and my rights to have the default removed from my account that would be greatly appreciated.

    Sadly I don't think there is much you can do about it.

    If I understand you correctly, you defaulted on the Vodafone contract because the cashback company failed to deliver?

    Unfortunately the agreement that you had with the cashback company would have been a completely separate contract. The fact that they failed to fulfill that contract gives you no legal right to default on the phone contract.

    I doubt that Vodafone have any room to help either - even if they wanted to - because I suspect that they are obliged to record the information on defaults accurately (i.e. they aren't allowed to "choose" not to record it as in default when it actually was).

    Thanks fwor. Although not what i wanted to hear, at least i know where i stand! I guess i better head over to the thread about repairing my credit score :) (and next time chose my battles more wisely!)

    margarino you could register a notice of correction with the credit reference agencies and lenders will take this into account when maing decisions about lending to you.
