I came to the UK in 07/2004 and have been working for one company since that date.I paid insurance contribution for the last 5 years. I have lost my job recenly and have applied for JSA, Housing and Council tax benefit but I have been told that I am not entitled to Job Seeker Allowance because I am not considered to be habitually resident in the UK. I will appeal to this decision anyway but my question is can I still claim Housing and Council Benefit without any proof of income?Thanks

Are you from a country that requires workers registration within 12 months of arrival? I don't know if this applies to workers from Poland, but you would be advised to seek experienced welfare rights. If you don't know of anywhere in the area you live, then give the local council a call & they will give you details of any such organisations in your area.The bigger the bargain, the better I feel.

If you have worked and paid National Insurance contributions as an employee for the last five years you should be entitled to Contribution-based JSA, irrespective of whether you are habitually resident. The habitual residence test does not apply to Contribution-based JSA.0
