Boss just got PCN

My manager has just got a PCN, obviously I have told but him not to pay it and ignore it but its a hire car.

In terms and conditions it says

Liable for all tolls congestion charges bus lane speeding & other traffic fines, penalities including penalty notices
I all have learnt is from others on many sites.
Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.

PRESS THANKS

A little more information would be useful, if you want some assistance. Read this sticky and follow the instructions.

I'm assuming your advice is based on it being a private PCN.

Some hire companies will just pay the PPC, and bill the hirer, plus their own "administration charge".

Your boss needs to inform the hire company that this isn't a legal fine or penalty, and that he won't accept any charges from them.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Thanks but i am aware of the sticky.

What more do you want to know I cant scan the PCN I am at work no scanner(I will try), but its from a private company.

I just wanted to know if he should inform the hire company about it and say that he wont pay as its enforceable. Thanks Bargepole for the advise I will tell him that.

Company is Town and City Parking Ltd that issued the ticket in an Asda carpark.

Boss asked me to put this on

car seat is removable and part of buggy ( no evidence of child in car when he is removed )
receipt from store says i paid by card 4 mins after first seen, and 2 mins after i was issued with fine
I was in store for 15mins prior to leaving
At no time did I see anyone, and IF he saw me exit car, why did he put 9:03, when i was in the store at 08:50am at least ??

    That's better.

You just said PCN in your initial post - we had no idea if it was a penalty charge notice from the council, or a private ticket.

All irrelevant. Just contact the hire company, and advise them that this is NOT a penalty charge, it is an invoice and the debt is denied. Ask them to record this, and ensure that nothing is paid, and no admin charges are sent to your boss. The wording on the hire contract does not include private parking invoices - that much is clear.

Sorry my fault, the issue he is having is should he tell the hire company about it and say that he isnt willing to pay it or is it going to cause alot of grief.

Its not like we only have a few cars hired from company possibly hundreds if not thousands hired from the company.

Would it likely go further up tha chain of command and possibly cause more issues than if he just paid the £30.00
