Uploading/ Downloading legality?

Hi Guys,
I know uploadinga copyrighted material is illegal as your not allowed to distribute copeyrighted material.
But where does the law stand with with downloading on a P2P net work.
i.e. in a hypothetical situation if you has a P2P programme but didn't share any files and only downloaded - is this illegal?

Its illegal if you have no rights to the material and common sense were to be left at home.
