Bad Bank Advice

Hi All,

Can anyone point me in the right direction for this dilemma...
Jan 2004 I suffered a serious heart attack and have been unable to work since, as I now suffer from ischemic heart disease.
When my heart attack happened my wife contacted the mortgage company who basically said 'tough'.
She then went to our local bank manager who suggested she take out an £18,000 loan to tide us over. She refuse this as I had been told that I would never work again.
He then suggested we use our bank credit cards to cover the mortgage each month which she did until the cards were full up. In the end we had to sell our house at a considerable loss and move into rented accomodation.
We then received a court summons for both of us for our credit card debt (which we could not pay) and as the hearing was in Northampton we had no way of getting to the court. Anyway the court did not advise us when the hearing was. We eventually offered £5.00 monthly payment on each debt which was accepted.
Has anyone had an experience like this?
I really wanted to get in touch with Martin himself but I understand that there is no way.
Is there any possibility that we might get our money back as we have no records of any of the above only the credit card payment records and the court summons.

  • Did you have a CCJ against your name?
    Are you aware that you could have applied to have the case heard locally to you?
    Did you claim credit card charges and probably mortgage PPI back?

    Yes I have a CCJ going back 12 years
    No we did not know that we could have the hearing heard locally
    and no we have not claimed CC charges or Mortgage PPI
    (whatever that is LOL)

    PPI is the Payment Protection Insurance you may well have taken out with your mortgage (and possibly credit cards). You may be able to claim on the insurance, for help with your mortgage payments. You may alternatively have a claim for mis-selling as lots of people have.

    I'm sorry that I have not replied sooner but here goes.

    WE received the summons in 2005 but I did not know anything about it as I was very ill at the time. I had just come out of St Thomas Hospital London after spending 3 months getting over MRSA after a heart by-pass, this left me very weak and my wife and daughter kept anything from me that could be stressful.
    I don't blame them but they didn't question the summons they just accepted it and offered to pay £5.00 per month on each count which the court accepted.
    As far as the PPI is concerned I did have PPI on both credit cards but 6months before my heart attack, because of the cost per month of the cards, I cancelled the PPI on both cards which the bank accepted without question.
