Annual Boiler Service problems

We bought our new build property in March 2008. A year on i'm trying to get an annual service done on our boiler.

When the British Gas engineer came round he told us that there was no access panel on the flue and as this didn't fulfill the regulations then he would not be able to do it.

This problem has occured with others on the development and one engineer even condemd one of the neighbours boilers!

They have mentioned that there was some change of regulations in approx November 2007. Now if this is the case i feel that i was sold my property after the change of regulations and am therfore not liable for the costs incurred to bringing it up to the required standard. I have been told that the costs wouldn't be ridiculous but i'm not happy that i should have to pay this at all given that i purchased nearly 5 months after the regulation has apparently changed.

My questions are as follows:

Does anybody know if any such regulations exist / have changed? If so what are the regutlations called? I feel that i at least need this information in order to challenge the developer on this issue.
