restarting my claim

before they decided to do the test case over years ago i was successful in claiming back half of my money. approx 1250gbp. i was in financial hardship then and i am in financial hardship now. they offere dme half the money back which i accepted. they said that if i wanted to claim the other half i would have to return the 1250 asap and wait for the test cases to be completed before i could claim. i left it knowing that this could be some time. As i am in financial hardship i would like to continue claiming for that other half but dont have the funds to give them the 1250 back. how can i get around this and ask for my other half to be reclaimed? money saving espert were extremely helpful in their letter templates and advice but i havent really seen alot of cases like mine.
I dont think at any point there was an agreement to close the file after accepting half of my bank charges back. definitely nothin gin writing so i should still be ok to claim them. please advise

Offers of settlement of claims made prior to July 2007 (the OFT test case) were invariably as Full & Final of that claim. Are you sure that the offer letter made no mention of that or that you didn't return a signed acceptance. The bank would be certain to resist any claim on the remainder on this basis, although that might change depending on the final outcome of the test case.
However there is nothing to stop you trying and you can certainly claim for any charges incurred since your last claim0 -
i accepeted the cash but i never signed anything or sent anything back to the bank. i just bloody received 2 more bank charges today for unpaid items. getting very annoying now. i think my claim was literally 2 or 3 weeks before they decided to put everything on hold so i was very lucky but i do believe i still have a case and would like to pursue it. is there a sample letter that can help me or can someone draft one up? wanted to know if anyone else was in a similar situation0

iv actually just rang my bank and asked them what my situation was. on the 25th july 2007 they paid me 1195 back of 2390 owed. this is the first time iv spoken to them in reference to this and i made it clear that i would be pursuing them for the remainder. they agreed that i had no acceptance as a final payout as i was just waiting for the outcome of the testcase.
i have just purchased 2 years statements to claim from that date as well.
i have to write a letter to the customer relations team now saying that i want to carry on with my claim due to my current financial position and give details of my hardship, enclosing a means enquiry.
so hopefully with a bit of luck i will get the other 1195 plus about another 400 in charges back very soon. i would appreciate any guidance in what to stress in the letter to make sure i get it all back.
