If they left the contract running could they claim for unpaid bills after the bankruptcy date?
Not finger pointing or nothing just curious, I have seen people posting about keeping mobiles after bankruptcy, Sneaky way for them to get you to pay?
Dont close the account so you run bills up after the date which are not included?
Thanks.0 -
I suppose thety have a legal obligation to close the account as soo as they are told by the OR that the debtor has gone BR & that the debt is included. If they keep the account open & run charges they are only exerting themselves as the BR's obligation to repay ended on the day of BR.
I suppose the companies try to get what they can / owed from the OR so by putting extra charges ion then maybe there's a chance that they will get their debt minus the new charges iyswim?
If you don't include a debt on your forms but enclose details in the OR's pack or at a later date, can the company argue that the debt is payable? It's just that a few people asked if the debt had been included on paperwork. What if it hadn't at teh time of BR (Court date)?BSC 289A life lived in fear is a life not living!Proud to have dealt with my debts.0 -

As long as the debt existed on the BR date then it is covered by the BR, whether you remembered to put it on the original paperwork or not.

Clearly this could be a grey area.
If you include the phone bill in bankruptcy but use it afterwards, Are you creating new credit? Bit like another post someone said BG will close your utilities account & start it again from £0
If you dont include the phone bill could they consider it giving preference to a credtor? But the small amounts usually involved make it not worth the effort to chase up?0
