Tax Credit back payments

Hi,
I've been a lurker for a while, posting on the BR board but Ihave a q regarding back payments.
My brother & partner are in a financial mess and have asked me to help them out. I was wondering how far back can you go to check that they have been paid the correct amount of tax credits & how far back can any back payments be awarded?
Any thoughts will be much appreciated.

if they are submitting the correct income figures every year, then there should be no under/overpayments occurring, so they should be getting the correct amounts
if its a case of them never applying, then tax credits can be backdated 3m

I know that they are not in a very good mental state at the mo, which is why I'm stepping in. We have been on wtc since april after i was made redundant last year and my wife put on part time working.
In 2008/9 our income was about £26000 so understand that we do nopt qualify for last tax year
However,£24000 of that was up until October 2008 and since then income has substantially declined-likely to be £9000 in 2009/10 unless i can get a job.
hence we are now on wtc.
between Jan 2009 and April 2009, income was just £1500.
Again-total income in tax year 2008/9 was £26000 but nearly all earned before october 2008.
Are we able to claim backdated (3 months ) wtc to between Jan-march 2009 and are we likely to get anything
any responses may help us both understand this wtc system a bit better0 -
tax credits is based on yearly income, so even if you earnt £26k in one month, or £26k over 12m, you would still be entitled to the same amount of ctc/wtc
so no, you wouldnt have been entitled to any extra ctc over the period between jan-mar 09 - however this tax year, if your income is only going to be £9k, then in april, you should have contacted them and given them your new lower income - if you havent done so already, contact them now, and tell them your income for this year is C£9k - in this instance, it should be back-dated to april (as thats still under 3m ago)

just remember to contact them again though, if you do manage to find another job, so you can give them your new figures, once you are working
