Nearly the end of an IVA but...
Options
Good Morning all,
Not found a situation quite like mine on the board so was wondering if anyone would offer their opinions/advice to my situation.
Technically my IVA would end of the 2nd of August but due to a varience i agreed due the birth of our first child i have a further 1.5 months to pay. Not a problem so far, have never 'missed' a payment and everything was agreed with my IP in advance.
At the begining of this year my wife, who has an existing spinal condition was involved in an accident and her condition now has worsened and she has been told to expect the loss of use of her legs within the forseable future (doctors say it could happen tomorrow or it could happen in years). My wife's mobility has been seriously effected since then has has stuggled to care for our children, or indeed care for herself (for example she cannot lift our son out of his cot, she has also been told not to do certain activities). After battling with getting her care during the day whilst i work for the past few months, it has become apparent that i will have to give up work to care for her and our children, since financially we do not have an excessive lifestyle due to the £500+ i pay for my IVA after benefits etc we shouldn't be all that 'worse off', allthough things will be tight. This thhough leaves me with the final 1.5 months of IVA payments. My wife's family have all put in and offered the final 1.5 months payments due to our situation which i am greatfull for, although i do feel slightly guilty in taking it as this was my debt for the IVA, not my wifes or her family.
My employer due to not being able to offer me part time hours, has agreed to let me leave without notice.
The question i ask is this, do i accept the money, pay the final 1.5 months and say nothing to my IP? My concern is that i will not be able to provide payslips for the period and would this consitute a failure of the IVA. Also the money offered by my wife's family, would that be considered a windfall.
After nearly 5 years i obviously do not want the IVA to fail, however i must now put the care of my wife and family first. I have no savings, assests and we privatley rent our home, my wife is nothing to do with my IVA on the financial side as the debt accured before we were married.
Any opinions, should i just ring my IP tell all or just take the familes money and wait for the end of the IVA.
Thanks

You could take the families money in monthly installments and if you explained it was to support your partner it would not be considered a windfall.0
