Help please Redundancy and my IVA
Options
Hi Guys,
Please help me as I am at my wits end here, and it's driving me crazy (literally). I have been in an IVA for approximately 1 year now, and pay £550 a month into it. I have never missed a payment, and have been plodding along since starting it up.
Out of the blue I have been made redundant, as soon as I was informed I notified my IVA people, and put them on notice. Once I received my redundancy package info I provided this to them too. I have never held anything back and have been upfront about this from the beginning (part of me now wishes I hadn't told them at all!).
I have been awarded the following:
£2275 statutory redundancy pay
£8769 for damages for loss of office/breach of contract
My IVA company have today informed me that I have to pay it all over to them, 100% of it!! I am livid, surely that isn't right? I expected to pay the redundancy pay but was under the impression that by law a person is entitled to keep damages payments? I have worked for this company for many years, since graduating and since being made redundant haven't been able to secure employment in the same role, hence the damages payment surely?
Initially, when I informed my IVA company about the payment I was still looking for employment and they gave me the impression if I didn't find work I would be likely to need to live of the money until I found a job. I am pleased to say with only a matter of days to spare I have now found new employment but it is not in my field of work (but needs must) and I have accepted the job, however, in doing so I haven't really done myself any favours as I have taken myself out of my line of work,...but needs must, I have bills to pay, a disabled husband to support and a home to run... sorry it's making my blood boil... I have tried so hard to keep my IVA up and now I feel totally let down by them!! I have read through all my papers tonight and cannot find any mention of damages, other than windfalls and redundancy payments, but I still don't think this covers damages.... Any advice greatly appreciated, as at the moment I am only 'inches' away from telling my IVA company to sod off and let myself go into default and accept a bankrupcy order being made against me.... Please help..... thanks Fweckles

this is not correct, good advice from the IP would be to be sensible with that money continue making your agreed payments and actively look for work.
If you have found work already you may be able to keep some of that money ask to speak to an IP, money paid for damages or loss can be exempt from an IVA.0
