my neighbour has flooded me is this right?

my neighbour upstairs had some sort of leak and as a reault water has seeped through my hall ceiling, ran down the walls in my bathroom and i now have 3 ugly yellow patches on my bathroom ceiling and also kitchen ceiling.
The flat upstairs is a private let, i own mine.
I contacted the factors today and was told they would inform the letting agents which they have...que a man looking at my ceiling and some rumbles from upstairs and now have gone away.
My question is now...i was told by my factors that there is a £250 excess on the insurance and as the leak came from the flat upstairs I would be responsible for paying the excess unless it was a fault that affected the whole building in that case it would be split 6 ways.
I dont see why I should pay the excess as it did not come from my flat, the property manager said the insurance take the view that because i am getting redecorated then i should pay...eh !!!!!!! If i wasnt flooded then I wouldnt need to redecorate!:mad:

If the water came from above then you should be claiming on the buildings insurance that the owner of the flat above has. You need to speak to the lettings agents and ask for the insurance details or instruct your insurers to chase them for you.

The damage was caused by a 3rd party. The 3rd party (or their insurance) is liable...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands
