What should I do?

I have an old account with capital one. It had a £250 limit on it and I went over my limit and it eventually went to a dca which I paid all the money back. I am claiming in total £781 which includes interest.
They wrote to me offering £232 plus £20 interest. I wrote back saying I wasnt happy and that I wanted the full amount. They wrote back again offering the same amount and that they wont be increasing the offer. This is the final offer.
The advised that I can contact the Financial Ombudsman within six months of the date of the letter.
Do I have the right to claim my late payment fees and my over limit fees back if it was passed to a dca?
Should I just cut my losses and take the £252?

Sorry forgot to add in their letter they said " the OFT hasnt told us that we're obliged to refund default sums and we've offered refunds as a gesture of goodwill. I wont be refunding all of the default sums as you've asked"
Surely this means they have refunded some so why have the not refunded all?0 -

staceymcpherson, you can claim these charges back from Cap One even though its been passed to a dca. I just have. Whole process took 3 months. Is the dca;- cap quest.
