Can he still claim after going bankrupt?

My husband will be going to court at the beginning of next month to finalise bankruptcy proceedings.
He wants to put in a claim for unfair bank charges and also unfair credit card charges- will he be entitled after he is declared bankrupt?

    Your husband is about to go bankrupt - then it is not it is not his money anymore.
     
    But your husband could or should declare those ’incoming monies’ to the OR and ask him/her
    to call them in and to distribute the lot among the creditors.

    Not really a question of having my cake and eating it- more a case of having 2 children to support.
    He had a failed IVA because he lost his job but wants to pay back what he can so of course we would declare it to the OR.
    It's money we weren't expecting so no great loss- just wanted to know where we stood.

    If the accounts are part of the bankruptcy then you lose the proceeds of any funds to your creditors. I would talk to your official receiver who will advise on that situation. Have you already explored PPI reclaiming and credit/bank charges already?

  • What an inspired idea- wish we'd thought of that! We were within 1 year of being debt free when my husband lost his job and we'd just had a baby- I'll come to you for you brilliant advice in the future.
