Not noticing a debit until a few months later...

If you had not noticed on a credit card that you had been debited (on continuous payment) a certain amount until quite a few months later will the bank credit you even for the 6 months before you did not pick up on it. in addition the company used also owe me a credit they were giving me as a bonus for using their company once! shoudl i claim off my credit card company??? or Visa? the company are claiming no liability and no longer responding.

I think there is a term and condition whereby you cannot claim anything over 90 days where you have had a statement but not queried the item in that time.
The credit card is only liable for a refund that was originally debited from the card so if the 'credit owed' did not originate from your card or you bought stuff which has subsequently found to be duff you will have no claim against your credit cardcompany.
You may of course take legal action to recover your loss.0 -
I do seem to remember that for CPA transactions the dispute rules were different. But you would have to check the Visa dispute rules to confirm.
I am still not sure if the CPA rules will help, but worth a bit of research.

cpa was done on halifax credit card. think at least 6 months or more owed so
over £100!!!
i have just read that the office of fair trading is putting a stop to some
high bank charges. maybe should also be taken up with them? ?????
how many people have the time to check their bank accounts within 90 days
all the time when they have kids, payments to make, house to look after,
work and make money. and what about old people!!!! i think this needs to
change!!! any ideas appreciated0 -
The protection you have comes from the Consumer Credit Act. Your credit company, not Visa, is jontly responsible with the retailer. I don't know about time limits and I don't think that you can claim the 'bonus' from the CC company. In case of CPA you obviously authorised it. Until now I was sure that all people do this regularly...how many people have the time to check their bank accounts within 90 days

You have enough time to post on here and complain about a CPA which you authorised in the first place, presumably without reading the terms and conditions, so reading and going through a MONTHLY credit card statement should not be beyond you. If it is then it is your and nobody else's fault. By law (Consumer credit act you have to be sent a monthly statement on a credit card if a transaction has occurred during that month). Sorry if you don't have time but don't complain now because you will have had SIX monthly statements showing this transaction!0
