Chinese seller gon AWOL - What to do?

Bought an item from a Chinese seller for £2.89 a week and a bit ago. Now I've just got got an email from eBay saying that the seller has had several breaches of eBay policy . The sellers account is no longer active. So do I wait a bit longer to see if it arrives straight away or open a basic dispute.
Iguess its a question of do I trust eBay or a complete stranger. I'm leaning toward the complete stranger as eBay are known for closing accounts for no reason....

Thanks for the advice so far. I received the item about 10mins after opening a dispute with paypal..... typical! . Anyway the seller refunded me straight away (well half an hour later) saying he doesn't mind and please pay when you receive the item! Odd ?
Certainly has a lot more faith in his buyers than I do!
Well I have it and it is working so I sent the money back. Problem solved.
