end of tenancy in need of help!!!

Can any one help please!

Me and my other half have just bought a house and move in 2 weeks time, at the moment were in rented property with derwent living housing assoiciation we have just wrote them a letter regarding ending our tenancy with them we dated the letter 15th june 2009 and they are now trying to make us pay an extra weeks rent because they recieved it the day after. Can they do that evan though it says from the date of 15 june 2009.????
can they do anything if we dont pay it???

    Did you send the letter in plenty of time to get to them before the date given as i dont think you can back date notice periods. If you did then can you prove that they received it before the date ie did you send it recorded delivery or anything and that they just failed to process it in time? I'm not sure legally where you stand but i would think if you did non of the above then they would be entitled to charge you the extra weeks rent. I'm sure someone with more knowledge will be along shortly :-)

    Depends on the terms of your contract. To start with, your notice only becomes valid when they receive it so dating/posting it on 15th is meaningless. Afterall, you might as well have dated/claimed to post it 13th, 12th, or whenever.
    You may also be able only to terminate on a rent day, ie at the end of the next full rent period (be that weekly, 4 weekly, monthly whatever).

    Can they do anything? Yes, if you don't give notice in accordance witht the terms/law then they can perhaps take it from your deposit (again depends on the terms) or sue you for it.

    Check your contract and then try discussing/ negotiating.

    Probably not what you wanted to hear, but they are quite within their rights to insist on the full notice period from you. As your landlord is a housing association this is probably 4 weeks notice which ends on a Monday.

    The date on your letter is meaningless, it is the date they recieved the letter that is important. They are quite right that if the letter arived later than Monday you will be charged another weeks rent.
