Capital One help & info needed...

Hello, I need a bit of help/info please...
On the 5 June 2009 I wrote to Capital One to reclaim £437.64 in late payment fees, overpayment charges and I also included the PPI which I never ever sign up for!!
On 12 June 2009 I received a, what I think is, bog standard letter to offer me £40 as a 'goodwill gesture' :rotfl: - as if!!! Two of the paragraphs which concern me are as follows:
When we opened your account in September 2005, we sent you a cred card agreement which stated these default sums. By signing and returning this to us, you agreed to the terms and conditions for the account, including the default sums.
The Office of Fair Trading (OFT) hasn't challenged the right of banks to charge default sums, just the level of those default sums. Capital One reduced the level of default sums from September 2006 to £12 each, following the publication of the OFT recommendation. However, I appreciate that you've incurred previous default sums at the higher rate, and would like to address this. (cue goodwill gesture).
What I was wondering was is this a similar 'initial' response received by other MS'ers and also, am I within my rights to continue with my claims for the £12 charge and send off Martin's 2nd template letter.
I apologise if I have double-posted but have spent the best part of my lunch hour looking for similar and couldn't see any.
Any help or info would be greatly appreciated.
