arrears help plz

Bit of a complicated one, my oh seperated form his wife and she left with their son, she tried claiming csa but as my oh was in full time education he was told to disregard any letters and he was exempt from payments. Last year one of his ex's turned up and told him he had a 6yr old daughter and she got in touch with the csa about 4 weeks ago as she wants money from us (oh has just left full time education and has started working full time and moved his studies to part time), so this has activated his ex wifes case now too which is fine as we were going to ring them now our circumstances have changed anyway. We are being told for his son we have 6 years of arrears as they have no record of him being in full time education, im managing to sort this and have posted proof to them of this and have been told if he was in full time education his arrears will be wiped off. In the meanwhile we have to arrange to pay off the arrears until they assess the case again. Atm they're asking for £214 a month for csa payments for his son and daughter but also asking for £300 a month to pay off the arrears which is leaving us with £75 a month to live off (food, nappies, cleaning stuff, toiletries etc) after paying our rent and bills which is impossible. Atm they have spread the arrears out over 11 months, does anyone know if i can spread it over a longer period? They also said its all going to be doe payments eventhough we have given them our direct debit details already, so could i ask them to keep it as direct debit?

    The maximum they can take on DEO is 40% if it includes arrears.

    As for giving them direct debit details, you should not have done that. They now have you bank records and in the hands of the CSA that is potentially dangerous. Should try by standing order as they have sort code account details for the CSA which you could pay in. yourselves

    I'm confused as you say he was told to ignore letters, I trust he had a nil assesment in writing?

    They told us they only accept standing order if your self employed so it had to be direct debit. Everytime he got a letter syaing he was working he rang them up and told them he was a full time student and gave them his student number and was told he didn't have to pay and to disregard the letter, he had about 3-4 of these over 6 years which was everytime his ex rang the csa and told them he was workign eventhough he wasn't.

    If they have DEO records, that is what they will use.

    I pay by standing order and I'm not self employed, but as asked and you have not answered did they put it in writing that he does not have to pay?

    I wouldn't trust those idiots with a DD. I'm employed & have paid by SO for a few years now without any problem.

    Never ever deal with the csa on the phone

    Only contact the csa by letter
    Send everything recorded delivery
    Keep the recorded slip and check delivery on the Post office website
    Keep copies of everything and don't lose anything
    Build a paper file
    and one more thing.....

    You can never get through on the phone anyway,we have been trying for a week and keep getting the message that there is a systems error.

    If you are worried about how much they want from you for the alleged arrears, go either to the Court nerist to you or look it up on the Court Service web site and get an application form N245. If you get one of these Court Warents then your repayment of arrears is set by the Court. They may not like it but they are like it or not stuck with it.
