It's laughable and outrageous for B&Q to claim that their own defective online ordering system, which was known by B&Q to be faulty for months if not years beforehand, was a "supervening event that was not caused by the actions of the Defendant".............

Too right, B&Q are negligent - they knew the state of their T&C's and for some reason failed to update them. Look at the new one's.

Stick to the facts - a "legally binding" contract was formed and since breached - simple.

............just a thought, but last Saturday when I put on my Lotto numbers I made an error and the numbers I should have put on actually came up and I should have got the jackpot. I put this down to a "supervening event" as the bad head I had was unforeseen and affected my judgement.
Do you think I have a case??
If yes, I will willingly drop my claim for the water butts.

In public, the Law Society would, at best and after considerable time, slap the offending solicitor on the wrist.
In private, they'd acknowledge that it was a brave attempt at salvaging a terminally holed ship. Professionals don't mind losing to other professionals, after all they get paid whatever. But they hate losing to amateurs.0 -

Exactly, their best bet is loss limitation. Show their skills at negotiation, which should have been B&Q's first step knowing the wording of their T&C's.

Rule 10.01 states:
You must not use your position to take unfair advantage of anyone either for your own benefit or for another person’s benefit.
The guidance to Rule 10 states:
Particular care should be taken when you are dealing with a person who does not have legal representation. You need to find a balance between fulfilling your obligations to your client and not taking unfair advantage of another person. To an extent, therefore, 10.01 limits your duty to act in the best interests of your client. For example, your duty may be limited where an unrepresented opponent provides badly drawn documentation. In the circumstances you should suggest the opponent finds legal representation. If the opponent does not do so, you need to ensure that a balance is maintained between doing your best for the client and not taking unfair advantage of the opponent's lack of legal knowledge and drafting skills.
