Dla refused and confused

:mad: hello everybody i Appied in feb 09 for dla as my son has speech and Behaviour problems after dozens of letters we cant reach the decision at the moment, then today we cant pay you because ? i dont know , i think it can be the nursery's report was not good. at home or outside is behavior is very danger, in the nursery he is a quite boy, but we still going to speech therapist. GP knows hes behavior gp said hes hyperactive (mind the spelling) at home you have to follow him every where he goes he gets stuck in wash machine, breaking all the cupbord he did set a fire 3 time 1 succed at home in the street worse we dong go to the parks becouse of his behaviour i get scared in case something happens to him we keep indoors. he also suffers from asma which is worse when hes asleep, i wont sleep because of the way he breaths is to noise i have to keep on checking him in case hes sleeping in bad way it gets worse somethimes like it starts as white staff coming from his mouth the next is vomiting all night we cant sleep i feel sorry for him as hes just 3,5 yrs Gp said is something to do with his lungs. i dont know what to do next, which step do i go, appeal or just leave it because is so much to deal with as am on ati-depression tables myself i dont know where to go i need help please .sorry for the long post u guys are the only friends i talk to. thank u:mad:

    I know how awful this whole process is. I'm in the 'waiting stage' myself at the moment and the thought of having to cope with an appeal is extremely daunting so can understand why you cant face it, but from what you've said I would think that you should be entitled to some element of DLA, but the way the forms are worded are just so important and you need to get the best person to do a report on how your son is at home. I'm sure when more people come online this morning there will be others with far more knowledge who can help and advise you. Good luck ! x

    You should get your doctor to refer you to a child phycologist, he might have ADHD or ASD, it's better to find out while he's young and allows you to access services in your local area!

    Did you have any help with the forms? No disrespect but your English is quite poor, perhaps you were not able to explain things in the depth required?

  • would suggest putting in an appeal with the help of either welfare rights or cab.

  • Get help from Welfare rights, or the charities linked to his conditions, and appeal. You won't get anything if you let them get away with it and you may very well get what you wanted as a result.

    Go back to your GP and ask for referral to the hospital too. Take a friend for moral support if it's possible that they're passing off the problems as Mum not coping with normal toddler. Make contact with the Health Visitor.

  • Hello,

    I think, from your post, you obviously have some anxiety about your child, and you need to leave that out of your application, as it will come across as an anxious parent.
    DLA is awarded for the care needed, over and above what you would normally expect for a child the same age without a disability.
    You will also need to separate the normal toddler behaviour, from that which could be down to a disability.

    Getting a proper diagnosis will help you, As will some good advice from Welfare Rights or the CAB.

  • This is my 1st time, please forgive If I've got it wrong. Devasted DLA turned down.
    I have got low rate care for 6 years,my husband has had to give up work to be my carer
    as I'm a liability and a walking disaster (sorry unable to walk in constant pain). I have multiple illnesses, the total support of my GP's. DLA never contacted. I think I messed up
    on the form, but had no help. Have done a lot of research and think I have Somatization
    Disorder. Would a letter from a psychiatrist quoting "long standing neurosis-type picture, with low mood and various somatic symptoms" be a diagnosis? Can anyone help as I'm
    confused at whether to contact DLA with this info (dated 17th Dec 2008)

    :confused: I'm confused, you day you're devastated dla turned down but mention low rate care awarded for 6 yrs. :confused: A 6yr award is excellent & certainly nothing to be unhappy about. I don't know why you are trying to diagnose yourself with a mental health disorder, but you need to be aware that contacting DWP further in an effort to get a higher award puts you at risk of having your current award reduced to a much lower term or losing the whole award altogether. There is a great danger of this happening if it's considered that what you call somazitation is in their opinon hypochodria if you decide to proceed with this.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.
  • Thanks Cattie for taking the time to answer, as I stated this is my first post . I do have mental health issues (18 years prozac 60mg per day). I am not trying to diagnose myself I just wondered if this was what the psych was indicating. My Dla is indefinate to to spinal injury which has sadly got worse over the years and we find ourselves in unfamiliar territory. As I said my husband has had to give up work to look after me, a decision that wasn't made lighhtly, he is an unpaid carer, we get ESA and it was my GP who suggested this and told us to apply for higher rate Dla both care/mobility with his backing. As I am virtually housebound, in constant pain and can no longer do the things I used to take for granted (simple things like putting washing in , hoovering, cooking the list goes on.) we're trying to make life a bit easier. Have you heard of somatization? I asked my Gp if he thought I was a hypocondriac and he said no. If you have knowledge of this disorder all I wanted was a bit of advice as I hadn't. Sorry If my typing is rubbish I'm a newbie!
