Delay in concluding missives when buying a part exchanged home - in Scotland

Hi,

Well the good news is that we have sold our home after approx three months on the market.

The house that we are looking to buy has been part exchanged for a new build Cala home, so effectively Cala are selling it. We have made an offer that has been been verbally accepted by Cala. So far so good.

It now transpires that Cala are not concluding the missives on their purchase of the part exchanged house until the day of the move, which means that they will not conclude the missives of our purchase until the same time. In Scotland I am used to missives being concluded quickly in the process.

My question is this. Is this normal practise for part exchanged houses and I have nothing to worry about or not?

    Are you using a solicitor provided by Cala?? If so I'd strongly suggest either
    a) Getting a different solicitor.. (Who do you think they will regard as their main client and who will they favour) or
    b) Get another solicitor to check everything....

    So, your solicitor has made a verbal offer to Cala, which has been accepted.

    Have they put the offer in writing yet? If so, has Cala's solicitor sent a 'qualified acceptance' to your solicitor?

    I wouldn't like the sound of this at all. You won't actually know that you've bought the house until the day you move in. Typically the sols conclude missives in advance of entry date, and all parties know where they stand, paperwork can be signed in advance etc.

    With this situation, as well as all the hassles of moving day, you'll have all the hassle of ensuring that you've actually bought the house!

    What does your solicitor say to it? He/she should be digging their heels and pushing Cala to conclude on this before moving day, not just meekly accepting it.
