How legal are contracts?
Hi
I had a phone call from EON, they wanted me to switch over to them. I had been looking to switch suppliers so agreed. Whilst they were on the phone they told me that I had 14 days to change my mind. If after that i changed my mind then I would have to pay a charge of £50 if I ended the contract before the 12 months was up.
In the meantime I found a better deal with Scottish Power, so I cancelled EON,within the 14 days. I sent them a letter, they claim they never recieved the letter. So they stuck a £50 charge on my bill. How legally binding are these phone contracts. I have never signed any paperwork.

Tell them you DID cancel in writing, it's not your fault their administration system failed0

I did tell them but they insist that it was after the 14 day cancelation period. I even sent a copy of the letter and emailed them but no joy0

What date did you sign up over the phone and when did you send the letter? If the letter was received after 14 days then it would not have been possible to cancel the transfer as it would have already been initiated. Why did you not phone up to cancel the transfer?0 -

Hi bobbyr,
If you can show that you tried to cancel before the 14 day cooling off period, you should be able to cancel with no charge.
If you are able to do this, I would ask for the issue to be escalated.
The contracts are called deemed contracts, so you don't need to sign anything.
Hope this helps.

I think the contract would be classed as verbal rather than deemed in this instance.
Eon spoke to the OP to ask for the supply to be switched to them, and the OP agreed. Usually such telephone calls are recorded by the supplier in case of dispute later."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100
