Hi Di
Can I just clarify, you're not paying them a penny out of any DLA are you?
Hi 10past6 how are you hunni?;)
Its taken a while for everything to settle over the new account, so I think as from next week all benefits are to be paid into the new account.
My loan was due a fortnight ago and of course they taken my token payment, and a few days ago as soon as my son's DLA went in they taken advantage of this and taken the full minus the £1 token payment from the account, so even though we lived on the overdraft, it was still my autistic son's money going the account, and they taken part of that for the repayment.
After I complained they did refund it straight back, they only done this because I complained.
I get paid Carers as well and yes they have in the past taken from that, but then I thought they could argue that we were using the overdraft???
All we get is benefits. The one and only "Dizzy Di"

What action should myself and di3004 take to stop those benefits being used? Is it worth phoning CCCS on Monday and informing them?
They have used those benefits in our recent review due to DH's redundancy as well.0 -
Yes because they know, it's more than they dare do to take that money. After I complained they did refund it straight backClick here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

They have taken mine into account as well hun.
Thought this required this for a full income sort of thing not sure.......

You must phone CCCS and make them aware what these benefits are paid for, the money must NOT be used towards any debt payment, it's not open to discussion / negotiation, end of, the benefit goes towards the person it's awarded to.SeaThreePeeO wrote: »What action should myself and di3004 take to stop those benefits being used? I just thought it was par of the course that all benefits were taken into account when doing a financial statement.0

Yes because they know, it's more than they dare do to take that money.
They done it a few days before as well with hubby's loan repayment, it was the money towards paying the mortgage arrears, although they did refund that as well after complaining.
Funny thing is they are stating that "we should have received the letters by now that they are unable to accept the token payments", but then we have not received any letters like that whatsoever, only the ones to confirm, "thank you for the token payments which they used towards the repayments", to me if they did not accept them they should have returned the payments......

They do not have to be included in any I&E, even if someone innocently included them , they CANNOT be used towards any debt payments.DLA, In Cap. Thank you 10past6. I don't know what I would do without finding this site and your wonderful advice.
I do find it odd though how the CCCS counsellor actually asked me if I was in receipt of DLA and Careers Allowance0
