was any company ever said so cant really be slander? I used to work for a doggy IVA company who used to claim they could remove defaults and ccj's, they used to buy d&b lists and call people cold calling. They couldnt do a thing so I can say there are companys like suggested0

He hasn't slandered anyone as everything here is WRITTEN.
It's not libellous either as 'the company in question' is not named or alluded to. The OP was a post about debt-management companies in general.0 -
Urm no, you have not slandered me and I cannot take you to court on someone else's behalf.
With regard to documented evidence I am not sure what you looking for, but I know someone who works in CAB and they tell me that unenforceability is becoming more and more accepted as one of the tools utilised to assist someone with debt problems.
In addition if you go on the National Debtline website, www.nationaldebtline.co.uk you will see sample letters geared towards unenforceability, such as requesting CCA's. At the end of the day, why else would you request a CCA if you are not hoping that they fail to comply with the request, thereby making the debt unenforceable ?
Unenforceability is common practice, like you say, and similarly these debt companies are utilising the laws - at the end of the day National Debtline, CAB etc all share one objective which is to help people in debt. If they know they can utilise unenforceability then they usually do try this - obviously they will be using the argument to the customer that they will not get credit for 6yrs but then any help is a help at the end of the day.
I think to prove this, simply ring and ask and you'll get told they do look into unenforceability. Documented evidence is easily obtained by checking court records, asking the debt counselling services and even reading the papers! It's not difficult Proliant!
There is no telling Proliant - he asks for proof when all he has to do is pick up the phone to get the proof he so desires.....
