moneyclaim regarding littlewoods direct

was not too sure what forum to post in as i posted on consumer rights
but thought it might get a responce on praise,vent,warnings too
hi all after some advice please
spoke to a solicitor on monday who is sending a letter to littlewoods direct on behalf of me, despite me sending them two letters one recorded del and one special del with all the info and evedince littlewoods requested from me
what happened
.may placed an ordered sony ps3
.may received a card through my door from courier parcel been left with neigbourgh went and collected parcel opened to find a sony ps2 inside,
phoned littlewoods direct up explained situiation and was told a courier had been arrranged to collect parcel from me and to put in a covering note in parcel to explain, so i re-packaged and put in a 3 page letter
.may after courier failed to collect, despite waiting in all day i rang again to arrange them collection
.courier collected parcel
.waited 10 days no refund onto account none showing
.may phoned littlewoods asking why i had received no credit on account was told it may take upto 14 days
.may 14 days passed still no refund so phoned again and was told a letter had been sent out to me
.may received letter saying item i had returned could not be re-used so would be put on hold for 6 weeks and then disposed of and on this occasion they can not refund my account
.may phoned them regarding the letter and was told it had been passed onto another department and i would be contacted (never was)
.may phoned again regarding no contact and no refund spoke to a lady who told me they wont refund as it was signed and delevired to you, i replied it was not delevired to me i have the hand in my card that was posted through my door saying it had been left with neighbourgh i aslo asked her to check the signature of who signed for it and read it out to me she did and it was indeed my neighbourghs, then she went on to say send a photo copy of the card left through the door do not send the origional with a letter explaining to this address so i did by recorded del
.june checked online and saw the letter had been delivered and phoned littlewoods to see what was going on to be told a different dep was dealing with it and they had not received the letter even when i told them i checked online and seen it had been delivered,whilst on the phone and said i was not happy about the late payment charge and legal direct recoveries was told to make payments to avoid this, i said sorry but would you pay for something you have never received whilst in a dispute with a company she replied but anything you pay should you get this sorted will come off any future purchase, i think not considering they have cancled my limit to £0 as have they put my Additions direct account that i had a limit of £500 and only £20 to pay to £0 so i got off the phone got another copy of the letter i had already sent added some more and sent it special del
.june (this monday) phoned them again to see what was going on only to be told again there is a 6 week hold as it can not be reused bla bla bla, so i went into the solicitors explained the whole situiation armed with dates, names ect and he offered to write a letter on my behalf
june (this wens) looked online and found my account had been re credited with the value of the ps3 but the fees had not, i assumed this had been an effect of reeiving the letter from the solicitors letter

06/06/09 Interest 8.27
total £20.27 p and p £3.95 total £24.22
june (today friday)
phone littlewoods direc to query these fees as they were fees on something i had not actualty ever had and when i logged into my account while on the phone was shocked to find everything had been added back on totaling £229 again furious i asked why the had re credited the put back on she said they credit your account when we receive the product back then we have re charged you 6 week hold bla....
i replied impossible as i returned the product back in may and have never been credited untill the 17th, she went quiet, i ended the call
what i would like to know is i am going back into the solicitors on monday to check when the letter was sent and when there deadline is up as i will be issuing summons against littlewoods direct
what can i claim for in terms of
£229 ps3 and fees
also they have instructed legal direct recoverys and this has shown on my credit report as is a late payment
(i want this removed asap as is the only bad credit on there
money spent on phone calls as i dont have a landline and they love an 0845 number i have spent approx £20 on my mobile and £15 in a public phone box, letters sent recorded del and special del
any help would be greatly appreciated as is anyone taking the time to read this whole mess, please excuse the spelling

why have you instructed solicitors ?
you do know that if you goto court you wont be able to get the costs for the solicitors back as it is a small claims limit
what is the solicitor charging you per hour ?0 -

i have not instructed the solicitors as such, i went in and asked for advice regarding the issue as i would be able to receive help with costs and he said they do not take legal aid but that they would write a letter on my behalf0 -
If you opened the PS2 and had it set up they have a legal right to charge you for that but they must also return the PS2 to you.Owed out = lots. :cool:0

i received a dusty well used ps2
i did not set it up, i phoned customer services as soon as i opened the package and saw what was inside0 -

I know you ordered a PS3 mate! However, even if they sent you a 2 grand computer and you even switched it on they can legally charge you for it.
Since you didn't take the PS2 out of the wrappers they can not charge you by law, your in the right and they should just accept a return as normal.Owed out = lots. :cool:0 -
