payment demands 6 months later!

Help, please. Back in January I purchased a baby cot from a well known toy store (online) I bought some other items aswell and paid with my visa debit card. I received delivery of all items and assumed that my transaction had been completed, as I believed that as I paid with a debit card then my delivery would only of been dispatched if payment had been received by the store. However 3 months later (end of March) I received a very dubious telephone call from someone claiming to be from this company demenading payment for the cot I had ordered. I informed this person that I had not received any official documentation from the company informing me of any problems and was therefore not happy disclosing my bank card details to this person via the telephone, I also advised this person that I would check old bank statements first and would also prefer a letter outlining the exact problem. I heard nothing for the following month, and then in April I received an e mail demanding payment for the cot, the e mail stated that payment had not been obtained back in January due to an error in this company's system! this issue has been ongoing now for nearly 6 months. I want to make sure that this company is allowed to demand this payment if they have already admitted the problem was theirs, plus they will not let me return this cot as it is outside of the 7 days return policy, I dont understand this as surely this 7 day policy does not apply as tey have not received payment and I have not entered into a credit agreement with them. I realise this situatuon appears easily solved, but I am angry at the way this company have been treating me, they have ignored all my requests for advice and information, plus why does the law seem to be on their side!! if they can have a 7 day returns policy then why can I as a consumer not have the same kind of deadlines!!!:rotfl:

    you were right to not give details over the phone

    i would also be wary of emails too

    i would ring them by numbers of the website and ask about it

    then request they send you written confirmation of it in the form of an invoice and that if they do so you will be happy to pay

    btw check your bank asap!

    you can go in and request your previous statements if you dont have them and make sure you didnt pay!

    You're missing out crucial information here!!

    Did you, or did you not, pay for the cot????

    If you have already paid, send them a copy of the bank statement (blanking out sort code and account no. etc...) proving you've paid.

    If they didn't get their payment, then PAY THEM! You bought it, I presume you've used it, you agreed the price at the time of purchase, so PAY FOR IT!

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Surely the 7 day policy begins the day after you take delivery so the company are within their rights (technically) to refuse a return. But why would you be going to great lengths to return something you haven't paid for and surely that would leave a baby without a bed?

    Check your bank statements and if the payment didn't go through then offer to pay them - maybe offer them instalments? If you haven't paid for the cot and you admit to receiving it then it could be classed as theft. Just because they made an error in charging your card, doesn't give you license to keep something for nothing although it is rather inconvenient.

    As Ivory Tinkler says:

    I can't really see what the OP's issue is.
    If she DID pay for the cot, why not just give the company the proof. :confused:

    I think the OP is hoping that someone will say 'Of course you don't need to pay for the cot, it was the company's fault that they didn't take payment'.

    I don't think people were being rude at all, your original post does not seem to make sense ... there was one flippant remark by Pollycat ....

    Confused about the 7 day return policy .... you've had the pram 6 months?

    As you say that you have prove that you paid them, well I would find out the name of the MD, write him / her a recorded delivery demanding that they leave you alone .... I would ignore all emails / phone calls - if they call, tell them you will not deal with them on phone, same with email - respond back saying that you paid & provided proof ... so will not deal with them by email anymore .... tell them you have paid already .... send copy of bank statement ... but remove account details .... maybe report to police for harressment??

    If you'd posted the full, coherent story to start with, maybe you'd have got different responses. :confused:

    I made my (possibly flippant) comment simply because you'd not made it clear that your bank statements proved that you'd paid this company.

    Why on earth would you write the above statement if you'd already gone through your bank statements and found proof of payment?
    Why would you want to be sure the company could demand payment if YOU'D ALREADY PAID?

    As isplumm points out, your original post did not seem to make sense.

    Now that you've clarified the situation, I agree with isplumm's suggestion for your next action - whether you require further advice or not. :rolleyes:
  • Must apologise for my initial thread entry, at time of writing entry I think I got a bit caught up with "ranting" and "snowballing" my thoughts, which is why it is a bit incoherent. Anyway, Im not sure this forum thing is really my thing, Im not that great with computers and do get a bit frazzled when using them. So once again sorry for the confusion. I received a letter of confirmation from my debit card company today proving payment was made to this company, however what they have done with it since then Im not sure, but at least I now have some tangible and official proof of payment made.
