Am I obliged to fill in an income and expenditure form in reclaiming...

Please help if anyone has reclaimed from natwest... They have sent me an income and expenditure form to prove i am in hardship. am i legally obliged to fill this in, or is this just another scare tactic to try and stop or stall my claim??? please help.:p

    Hi,
    We're going through the same palaver with the Yorkshire Bank. It's disgusting that they can request this of us.

    Why?

    They ask you for these if you are claiming under hardship. As many people put in false claims or even fraudulent claims, they cant accept what you say on face value. They have to verify if what you say is correct.

    They are correct to ask and you will have to fill it in.

    Kath. you don't have to fill the form in, that is your choice however under the FSA Waiver on Bank Charges, Annex 2 which is the hardship criteria it says on point 6

    "6.
    Where the firm does not have sufficient evidence to assess whether or not the complainant is in fact in financial difficulty, the firm will seek such further relevant information as is reasonably required to make that assessment. In the event that the firm reasonably requires relevant information to be provided by the complainant and the complainant does not provide the requested information within a reasonable period of time, the firm shall not be obliged to treat such a complainant as being in financial difficulty."

    Some people have bank accounts with other companies which they cannot view, some debts may not have arrears as they could have been paid by a significant other. There are multiple factors in financial hardship.
