No, as I understand it (I might be wrong) no intent needs to be proved as we are not saying it was deception, as under the theft act. But under consumer law their advertising and pricing has to be correct, clear and easily understood. You don't have to prove they intended to fool you just that you were fooled. (i think)0

No, as it's a strict liability offence.
