returned standing orders! please help

my daughter attends a sporting club which has monthly membership by standing order, this months money was paid to her instructor except for some unknown reason this time his bank returned it to mine!
i budget my money to cover my bills but every now and then i see that what i dont spend has built up a bit, thinking yesterday i had some extra i brought my kids some dvds, now it appears it was the money from the standing order, which had originally been paid to the instructor.
surely he can reclaim this as it the error on part of his bank, he basically telling me that unless i pay it myself then my daughter is not welcome as i wont be me that covers the fee!!
can he get this refunded by his bank??
have also left this in bank charges as not sure where it belongs!

I'm a little confused as to what you're asking. Has the instructors bank tried to reclaim the standing order? If so does that mean you've been charged by your bank for the non-payment as i assume there were no funds to cover it?
To be fair on the instructor his problem is he hasnt been paid, and he's within in his rights to say what he has said although he doesnt seem that understanding to me.
if i get you right what you're saying is you dont have the money to pay the insttuctor and feel that as his bank made a mistake he should go after them for the money.
Think about it if it was the other way round. If you did a service to me and hadnt been paid would you chase after your bank for money i should have paid you?
His bank returned the money to you which you (unwittingly) spent. There is no way he'll chase his bank for the money because its not them who he instructs at teh sporting club its your daughter so i'm afraid you'll have to pay up.

the money went from my account to his, but for some unknown reason the bank sent it back, this is a standing order that has been in place for 3 1/2 years.
i understand that he warrants payment, but that payment was technically made by me on its due date, i had no idea it had been returned until today.
this just surely cant be right?
on what authority would his bank have returned the money when the s/o is meant to be in my control?
no the bank hasnt tried to reclaim it, i made the instructor aware0 -
if there was no problem with his account then the bank made a mistake. however my point is if the instructor does not want to pursue his bank (if that course of action is open to him) you have no real option but to pay him.
maybe i'm wrong but i doubt it.0 -
Unless the instrustor has changed his a/c details eg moved from one type of a/c to another, which involved a new number being issued, or the receiving bank's computers having a funny five minutes, I can't see why they would have refused to accept an incoming standing order.
As you know standing orders are originated by the payer's bank, not the payee's, and as such the latter cannot request payments from the former. I would have thought it much more likely that your bank reclaimed the payment for some reason and that is why the money went back into your a/c. Do you have any unpaid fees for that day? I suggest you contact your bank and ask them to suggest what went wrong on this occasion. E.g. perhaps the money in your a/c was uncleared?
You will just have to pay up and chalk it down to experience. I would have thought it extremely unlikely that even if the instructor was willing to go through his bank, which he isn't, they would be willing to pay out.
Also double check the a/c details of the payee.0 -
As the above post calls out standing orders are actioned by your bank, whereas direct debits are called up by the other person bank. In your case for some reason your bank made the payment and either recalled it or the other bank could not accept it for some reason and was sent back. You need to check with you bank why this has happened - though I guess they will say that it was a quirk in the system. Anyway, the instructor did not receive the money and it is up to you make arrangements to pay him - it is not his fault that you unwittingly spend the money that was returned to your account.0
