Paypal seller appeal

Hi there.
I have bought a second hand phone on ebay and the item wasnt in full working order.
I dispute this on paypal and escalate.
My paypal case was closed today.I was granted full refund for the phone because was not as described.
Now the seller appeal to this claim.
I took the phone to a repair centre but they only connect it to check what is wrong,the phone hasn't been opened
I have sent a phone in original condition to the seller. Is there any way that he can win the appeal and get his money back??
Is there a way that he can win it and proof that i've open the phone? (but never did!)

Surely you have opened it, to connect it to check what the fault is?

If you've doen this all through Paypal you will have to pay for the return (and probably wont get this refunded), and you, as the buyer, are pretty much 99.9% likley to win the dispute, regardless of what the seller can prove or disprove.
