Buyers sol considers our lease to be defected

Just got off the phone with my sol. Basically she has had a very lengthy letter from buyers sols saying that our lease (125 year from local council with £50 annual rent) he considers to be defected due to a clause in there which states that the council have the right to review the annual rent every 25 years. He says that the body that overlooks mortgages wont agree to this and we need to change this. Apparently there is a form we can get from the council which will do this.

Our sol has never heard of this, nor has any of the other partners in the firm. She telephoned our local council and they havent a clue about the form to amend the lease either.

Now to top it off he has jetted off on holiday for 2 weeks.

He is known around here for playing for time, being a bit of a !!!!! so not sure if he is just mucking about so to speak until he comes back off holiday or what.

Anyone have a clue what he is talking about?

    There's a specialist lease forum elsewhere ... you should be able to bing it (bing.com - because it's not google)

    you may need him to write a Deed of Variation - that is sometimes required when buying ex-local authority property. this means your sol will have to write a new clause and submit it to the council's solicitors to see if they agree the change. You may have to pay for the councils solicitors fees also.
