advice welcome!!

OK here goes,

Creditor £Amount (Collection Agency)
Halifax Credit card - £1067 - (Blair oliver and scott)
Citifinancial £3880 - (?)
Halifax loan - £5100 - (IQor)
Goldfish credit card - £1800 - (Thames credit)
Severn Trent - £257 - (Lowell portfolio)
Eon - £577 - (Buchanan, Clark +wells)
Debit finance - £207 (?)

Thats the lot I think. So i'm looking for any advice on what i should do with these debts. Here's the situation with each of them:

Halifax Credit card - have spoken to BOS, and informed them that I am currently re-claiming the charges on this account. Recieved a letter from halifax offering me £257 goodwill, I have actually claimed £1200 so hoping another offer will come back and just wipe this debt out!!

Citifinancial Loan - Moved address since last time I paid anything on this one, about 2 years ago I think. not sure what to do because I know that PPI is on this but dont want to rock the boat.??

Halifax Loan - not paid on this one for about 18 months, had a visit from IQor rep on monday, dont want a repeat but dont know what to say to them???

Goldfish - same as citifinancial really, no payments for ages but I know there is a lot of charges if I ask for them. again not sure whether to rock the boat??

Severn trent. Not heard from them for 6 months, only found out its with Lowell cos its on my credit report. again dont know whether to contact them or not as the letters seem to have stopped.

Eon. Get phonecall from BCW every day, letters as well, dont answer cos ive spoke to them once and they were very aggressive.

Debit finance. not sure who has got this debt never heard from them.

So, i will be able to raise about £600 lump sum in the next month should i write to the lower debts and offer reduced F+F settlement sum?? and the ones that I dont get correspondance from, what should I do??

I ve recently accepted a financial hardship claim from Halifax of £133 and 3 months no charges (from a £3000 claim), just to try and get out of the vicious circle of being overdrawn every week therefore getting more charges.

Any advice would be welcome as i'm starting to get depressed by the debts. MAX i can afford to creditors per month is £130 as with 2 kids and only 1 proper income, theres not much left to go round.

    Go to citizen advice, it's free and they are very helpful. sometimes they talk to your creditors for you, take all your outstanding amounts and earnings for them to work it out with you

    Before trying to arrange any payments, i would suggest posting up a Statement of Affairs so you can see exactly how much you have available to pay towards the debts and we may be able to suggest some areas in which you can make savings.

    For those phoning you right now, there are some letter available on the site that you can send to request that all communication be in writing only.

    If you do make a settlement offer, you will be restarting the statute barred clock. It might be better to make an offer only to those that are currently pursuing you - not sure.

    If any of them do get in contact again and start threatening, you could reclaim charges, PPI and request a copy of the CCA. I take it most of these debts were taken out before 6th April 2007?

    Sorry if BCW have come across as aggressive. I do understand the stress your situation must be causing and there may be ways we can help.

    The important thing is to contact E.ON. Discuss your situation with our credit advisers and see what can be done.

    Accounts are only referred to BCW after several weeks of chasing outstanding balances. How long does the period of the debt cover? Have any payments been made previously?

    I would make sure your bills are accurate. If they are estimated take meter readings and let us know. Your account can then be re-billed accurately.

    Ask for a payment arrangement. We will be happy to spread the balance over a set period which you may be more comfortable with. The debt can also be included with your ongoing usage to prevent a similar situation happening in the future.

    If this arrangement is not suitable you can always have a Prepayment Meter fitted. This will allow us to set the debt on the meter to be collected weekly at a much lower rate.

    Are you on benefits? If you are there may be other ways we can help.

    For instance, I see from your post you are with Severn Trent for your water. We work with Severn Trent to provide debt relief for low income families. This is through their Water Trust Funds.

    There may be other ways we can help too. It depends on your circumstances.

    As I said above, the important thing is to talk to us. If we don't hear from you BCW will continue to chase the debt as we will not know any different.

    You say you don't want to rock the boat on a couple of the loans, however if you did not tell them you were moving house then the debt won't become unenforcable after 6 years, so it might be worth sorting them out rather than letting them acrue charges etc in your name until they find you.

    Yes they al were before 2007. what does this mean??

    True, but while they are not in contact with me should I concentrate on trying to sort out the ones that are chasing me??

    If the credit agreement was signed before 6th April 2007, it must have all the prescribed terms on it for it to be a legal document. Agreements signed after this do not. If your customer credit agreement (CCA) does not have all the required terms then it may not be enforcable. If they started to threaten court action, you could use this to your advantage.

    When was the last time you made a payment towards the eon debt?
    If you were to send a letter, that would restart the statute barred clock. If they agree to a reduced settlement (I'd start at around 50%) then you will need to get that confirmed in writing before sending payment. You must make sure that it is a full and final settlement and not a partial settlement - there is a letter available on the board if you need it.

    I agree, i would concentrate on the ones that are actively pursuing you right now.

    Sorry roberto but we do require payment for all energy used.

    Reductions are given where we are at fault for not billing correctly but if the billing is ok then we will need you to pay for the energy used in full.

    However, as I said in my previous post there are ways we can help you with this debt. You are doing the right thing in talking to us.
