I am really worried as I have received two letters from Lowell Portfolio/financial about a bank account I had with the Abbey which they have told me they have 'purchased' from Abbey. As far as I was concerned when I complained to Abbey about my bank charges in 2007 they acknowledged my complaint and I thought they had put my account in dispute as I have not heard from them for two years. Lowell Portfolio now say I owe them £4,500 and I am worried sick. I wrote and asked them for a signed agreement and sent a postal order for £1 to them but they sent that back to me and forwarded me a print out of transactions with my Abbey account number on top, not my name and nothing that says Abbey on it just plain paper with figures on it. They said that bank accounts don't come under the consumer credit act and if I dont pay them the full amount they will take me to court within 7 days. What shall I do. I thought my overdraft with the Abbey was £2500 and I also thought that because I had not heard from them for two years they had put it into dispute because I was due back about the same amount in refund of bank charges. They even took it my bank account off my credit record within two months of me complaining. Please someone advise me, I dont think I can sleep tonight with worry. Thank you.0

They are correct insofar as bank accounts not requiring a credit agreement - they do still fall under the CCA74 Act, but that's just semantics.
When the banks were allowed to put the bank charges on hold, part of the agreement was that they do not pass the accounts on to DCA's. The debt is definately in dispute and should not have been passed on.
Write to Lowell stating that the account was in dispute with Abbey and should not have been passed on to you.
Typical that you get this when the bank charge case starts at the House of Lords.

recieved a letter yesterday from halifax re.credit card charges, they have repaid me £909 charges + 208 interest. Cleared my balance straight out, plus got a cheque coming for £122. first debt cleared!! come on!! only about 12k to go, anyone know whats happening in the house of lords court case would love to take another £2900 of my debt with all my bank charges!!!:T0

It's due to finish hearing today, but unlikely to be decided until the Autumn. Also, it could then go to the European courts, so don't count on seeing any money any time soon.
Important thing is to throw the payment you were making to Halifax to the next card you're clearing, rather than absorbing it into your spending money.Debt January 1st 2018 £96,999.81Met NIM 23/06/2008

Hi everyone, a quick update.
the severn trent debt has been passed to moorcroft(?) has anyone dealt with them before i am guessing they are going to be as bad as the bcw lot. also the guy at severn said that the debt has gone up to £466, i had informed them of my change of address in october but have not heard anything back, decidied to ring today to try and arrange repayments but was told its passed on.
Rang Eon as well was informed that the debt has been sold to BCW so nothing they can do about it(?) So i might ask bcw if they will settle @£300.
as your advice is welcomed and appreciated!!!!

Hi rob
Even though the debt is now with BCW you can still set up a payment arrangement with them. I would give them a call and outline the cirtcumstances. See what they can do.
