council house problem need help asap

my mum lives in a 3bed i live in 2bed high rise flat her house is not up for bidding she has just won a 2bed house and can sign for keys now this is problem.
i lived in her 3bed house till i had my son he is now 2and im married he works 10 min from house. i need to know if its poss that i can sign for my mums old keys and hand in my place or can she keep the keys and pay for the rent on 3bed while living in 2bed.
any advice so i can get this house please help.

    Sorry but the Council / HA will ask for the keys back on the 3 bed once she has accepted the 2 bed house (giving her time to move of course)

    No - you have no rights to your mums tenancy.

    She will need to give the council vacant possession. Depending on how the council scheme works it may be that she got additional prioirty for 'downsizing' from a 3 bed to a 2 bed property - and if you 'swapped' she would lose this.

    If the council were to agree to your idea they would, in effect, be giving you prioirty over everyone else looking for a three bed house. I can't see them allowing this.

    I do agree with the earlier posters. There's no harm in raising it with the council and getting an understanding their process for people wanting to move properties but they usually slavishly follow an allocation process that doesn't get influenced by personal entreaties.

    My brother did manage a swap of a 2 bedroom flat with his in-laws for a 3 bed house but this was done as a mutual exchange that got permission rather than the scenario you describe where a tenant transfers somewhere else.

    Perhaps you can persuade your mother to withdraw from moving to her new place and swap her current property for yours if you meet the rules for the size of property she has?

    I'm assuming her mum does not want to live in a 2 bed high rise when she has been offered a 2 bed house in exchange. not being rude but if she wanted to do a swap with her daughter she would have done so. There is no way the council will agree to the OPs demands as there are so many people on the waiting list for properties it would be unfair to give her priority.

    No, they won't allow this - I expect they have families queuing up for the 3 bed place your mum has vacated.

    They will want her to relinquish here old tenancy at the same time as she signs up for new place - and they will require the keys back from whatever date the tenancy changes.

    Her old place will be offered to whoever is top of the list.

    If you need a 3 bed. or a low rise, then you will have to go onto the tranfer list or try for an exchange.

    That would be my assumption too but I think its worth floating this idea.

    In the case of my relatives, the retired in laws did in fact move into a block of flats (albeit low rise ones) in a nasty part of the estate in order that their daughter could bring up her children in their large house where she herself grew up. They made the sacrifice in order to keep the property in the family.

    The in-laws were hoping that they would then transfer into a sheltered housing scheme. It was a risk they took and it paid off because within the following year, they were then offered a bungalow in the nice part of the estate.
