What Dalip means MR is that the OR will check with the DVLA if you own any cars. So people can't just say that their car is their fathers car as it is worth £5k and they don't want to get rid of it.

Yep that would make sense, but the OP states he's using a friends car. It's kind of a mute point anyway, as it's obviously best to disclose the truth anyway on the SOA.

I can see the OP's point, on the SOA it's kind of quite a random question about using other people's cars and I don't blame people if they are wondering what the Insolvency Service's intentions are

I think the SOA should have a bit in brackets stating "don't worry we wont take your friends car just because you are BR" :D

If they don't ask you won't be able to put running costs for the car on your SoA. They'll just see you don't own a car and assume you need no petrol allowance.

There's also the fact that of you own the car the OR is liable for any accident you may have until the car is officially exempt, obviously if you don't own the car they're not, so they need to know incase you write it off.

Liable for accident? I assume you mean in terms of losing £££ in the car rather than liable for running someone over or something?

Liable for what exactly? Just curious ;)

I've put £60 per month down for travel / petrol because my husband sometimes uses my Dad's car to go and see clients or I give my Dad petrol money when I need to take my daughter to hospital. I can't drive myself so should I say yes to the question? It's only me going BR.

I've put his work petrol expense down because his income is roughly 50% of mine so all the expenses are joint IYKWIM but it would be a waste of time for the OR to check with DVLA for a non-driver I suppose...

No, I mean liable for the costs of accident. If you lose control of the car and wipe out a bus stop, 2 lamp posts and several pedestrians the OR is liable for costs for the lot. Oh, and the loss of the car.

As soon as you go BR your car as a viable asset belongs to the OR until exempt.

Oh they have done before, just because you can't drive doesn't mean you can't own a car

Wow! I'm shocked. I would have figured the insurance company would have been the one's liable. Not disputing what you're saying, just suprised.

But the OR isn't covered by your insurers.

I can vouch for that peachy. I do not drive(and told him that) but my OR asked for all cars registered to my address and who owned themfor wen he checked with the DVLA.dX

I am using my parents-in-law car but we had to put it into my name as otherwise my insurance company refused to insure me - so I will show as owning a car even though I don't?
