iPhone upgrade

Did a quick search and couldn't find this question already being asked, but sorry if it has been!
On the 26th May I bought a new iPhone, on pay-as-you-go to replace a contract one that was stolen -insurance claim pay out - and so paid £395 for it (16g white).
On June 8th Apple announced their new product, the 3GS, a day before my 2-week cooling off period, but I was unable to go to a store and discuss the problem, plus as I had been without a phone for 3 weeks due to the theft I was reluctant to wait another 2 weeks for the new model if I returned the old one.
I am basically asking if I have any rights to exchange the old substandard product for the newer model as I had no idea that it would be released when I bought mine, and if I had I may have waited for the newer version?
I have asked both O2 helpline and the Apple phoneline and neither knew either way, just said go ask at the store I bought it from - apple store, regents street. I have seen on apples website that here is no upgrade option available.
Something similar happened to me with another apple product - bought an iBook a week before they announced an upgrade. On that occasion they just swapped them for me, but not sure if they will this time....
Basically, I wanted to know if they have an obligation to exchange it, and if not, has anyone got any tips on how I could 'encourage' them to do so??

Yeah the iPone is a great toy thats for sure. My only problem is you can't muti- task with this phone, if your running a application you have to close it first before you make a call or surf the web. I can't wait for 4G!!!!
Is there an applacation you can run while you do other work on the iPhone?jeff0
