Capital One and 6 year limit

I sent a LBA early in 2008, then having sent a second letter telling them that I wasn't happy to be ignored I received a response basically telling me that I wasn't going to get a refund because I signed T&Cs etc. I sent a second letter and then received an offer. As it was less than a third of what I was claiming I declined their offer!
Anyway, I've had a pretty difficult six months or so and didn't follow on with my claim. Question -
If I was to continue my claim, ie, I shall now be filing in Court, some of these charges now fall out of the six year period. Does the date of my claim start from when I initiated the claim, or does it start with my court claim date?

If your last contact with the bank was over 6 months ago, I think this will have to be a fresh claim.
This is based on most final responses from companies giving 6 months to contact the ombudsman.
Not sure if it is correct, but someone will confirm soon.No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

Thanks for your response. So as my parting statement to them was on the lines of "I shall not hesitate to begin legal proceeding without further warning" should I notify them that I shall now be going the Court route?
I shan't be losing out by much, but it's my money and not theirs!:rolleyes: I just don't want to lose out on something if I can actually claim it back. BUT I don't want the Court to reject the claim because I've claimed outside the timescale.0
