I have asked my friends wife to ring the insurance company up and request a claim form, if they dispute the claim then they will seek legal advice. Once there is an outcome either way, I will post again.

I had this problem with a horse that I insured and involve a solicitor heavily and the Ombudsman,

The policy excluded "pre-existing conditions".

I bought a horse and had it vetted (like a medical). The vet detected several problems that were minor in nature.

Several weeks later the horse was found to have a condition know as "navicular disease".

The insurer's veterinary advisor said that this had to be a pre-existing condition because it would have developed prior to the time that the policy was taken out.

However, it was agreed after much intervention that unless the condition can be diagnosed for what it is at the time of insuring then it is not a pre-existing condition.

The insurer paid out. They had to accept the risk in good faith.

The condition may have pre-existed but it could not be detected upon a routine examination at the time of insuring.
